Initiative: Property Rights/Eminent Domain

Number of States Voting: 12

Where: Arizona, California, Florida, Georgia, Idaho, Michigan, Nevada, New Hampshire, North Dakota, Oregon, South Carolina, Washington (Louisiana approved a measure in September).

Proponents Say: If property is seized, and just compensation is given to the owner, then it benefits the community by allowing developers to enter and modernize an area, thereby providing larger tax revenue for the entire municipality.

Opponents Say: Government seizing property for development use is unfair because it puts private owners at a disadvantage and gives bureaucrats the ability to abuse eminent domain as defined in the U.S. Constitution.

Eminent Domain Measures Approved in: Arizona, Florida, Georgia, Louisiana (passed earlier this year), Michigan, Nevada, New Hampshire, North Dakota, Oregon and South Carolina.

Rejected in: California, Idaho, Washington
