U.S. District Judge Mary Lou Robinson Tuesday threw out part of the lawsuit brought against Oprah Winfrey by Texas cattlemen. Judge Robinson ruled that the suit, now in its fifth week of trial, would no longer be heard under a so-called "veggie libel" law that forbids the false disparagement of agricultural products. Robinson said the case would continue as a "common law disparagement" suit in which the plaintiffs would have to prove malice on the part of the defendants. The suit charges that Winfrey cost the plaintiffs at least $10 million because the mad cow show misled viewers into thinking that U.S. beef was unsafe, which triggered a price drop.

Downey's Brief Jail Break
Actor Robert Downey Jr., serving six months for violating probation on drug and weapons charges, was allowed out of jail Tuesday for a day's filming at Paramount studios, a Los Angeles TV station has reported. KNBC cited a jail spokesman as saying the Oscar-nominee (for "Chaplin") was accompanied to the movie set by two deputies and a supervisor. Due to be released next month, Downey, 32, is being investigated for his part in a jailhouse brawl last week which necessitated his being treated for a cut over the nose.
